Buyer(s) hereby agree(s) to purchase the abovementioned Labradoodle, and Breeder(s), Ned and Susan Davis, dba Davis Doodles agree(s) to sell the abovementioned Labradoodle under the following terms and conditions:

Initial Health Exam: Buyer has five days from the time puppy leaves the custody of Davis Doodles to have puppy examined by a veterinarian of his/her choice at Buyer's expense to verify the general health of the puppy. Buyer may return this puppy to Davis Doodles at Buyer's expense to receive a full refund if this puppy is found to have a life-threatening illness. If this puppy is found to have a minor illness requiring short-term medication at the initial health exam, Buyer is entitled to reimbursement of medication cost by Davis Doodles. Proof of examination and diagnosis must be provided to the Breeder within the five day period in order to receive any reimbursement of funds. Davis Doodles reserves the right to a second veterinary opinion.

Health & Maintenance: This puppy has been sold to the Buyer as a companion animal and/or family pet.

• Buyer agrees to provide this dog a safe and appropriate indoor living space.
• Buyer agrees to provide adequate shade, water and housing during periods outside.
• Buyer agrees to provide veterinary care as needed as well as maintain appropriate veterinary protocols for immunizations, heartworm preventative and any other medical treatment recommended to maintain the highest quality of life possible.
• Buyer agrees to properly train this animal in order to encourage positive behavior which includes initial crate-training.
• Obedience training is recommended, but not required.
  
• Buyer agrees to provide adequate opportunities for exercise to maintain a healthy lifestyle. However, to ensure healthy bone and joint development and in order to maintain the health warranty, excessive running on concrete prior to 15 months of age will be restricted by Buyer.

Buyer's Agreement: To support the Breeder in maintaining a breeding program that produces healthy, well-adjusted dogs, Buyer agrees to provide the Breeder with the outcome of any health tests (such as hip evaluations, eye exams, cardiac or thyroid results, etc.), as well as any temperament or behavioral issues that arise with this dog. Buyer further agrees to contact the Breeder prior to this dog being re-homed, taken to a shelter or euthanized for any reason. The Breeder maintains the right to take the dog back, to assist in re-homing the dog or to screen potential new owners should the original Buyer choose to surrender ownership of the dog for any reason. No refunds or reimbursements will be made, and all warranties are null and void upon notification of Breeder of the intention to voluntarily relinquish ownership of this dog.

Spaying or Neutering: Davis Doodles does not perform ESN (juvenile spaying or neutering) on puppies due to the possible risks associated with completing the procedure prior to 8 weeks of age. Instead the Buyer hereby agrees to spay or neuter this dog prior to 7 months of age. Buyer further agrees to provide a signed copy of the veterinary certificate from the veterinarian who performed the procedure to Davis Doodles as verification that it has been completed. Upon receipt of the spay/neuter certificate, Davis Doodles will information for the puppy to be registered with the ALAA by the Buyer.

Breeding Rights: The breeding of our dogs without purchasing breeding rights is NOT an option. The bloodlines of Davis Doodles' Labradoodles are of great importance to our breeding program with regard to health, temperament and conformation. We require specific genetic testing of our breeding dogs in order to maintain complete breeding control over our lines. By purchasing a pet puppy from Davis Doodles, you are hereby agreeing NOT to breed this dog and to spay/neuter this dog by 7 months of age. If you breed this dog intentionally or unintentionally, you will be considered in breach of this contract and required to pay $10,000 to Davis Doodles, the purchase price of a Davis Doodles breeding dog. In addition, you may be asked to surrender the ownership rights to your dog at the discretion of Davis Doodles. Davis Doodles will pursue any legal action available if the Buyer is found to be in violation of this agreement.

Breeder's Warranty: A warranty against hip dysplasia is provided for two years from the whelping date of the dog. Buyer must provide Breeder with proof of hip dysplasia through documentation from PennHIP or OFA, including films and any and all veterinary reports associated with hip dysplasia diagnosis. Breeder reserves the right to obtain a second opinion of diagnosis by the vet of our choice. If dysplasia is confirmed, buyer will receive a replacement puppy from the first available litter or a full refund of purchase price if buyer has complied with the guidelines for protecting the developing hips of the dog and if the dog is not seriously overweight. Buyer must promptly notify Breeder prior to beginning any treatment or choosing to euthanize the dog or this warranty will be null and void.

No Financial Responsibility: Except for the above limited warranty, the Breeder assumes no financial responsibility once this dog has left our custody. Buyer hereby agrees that failure to honor all conditions of this contract can result in the Breeder reclaiming the dog without compensation to the buyer.

By signing this contract the Purchaser has read, understands and agrees to all conditions and terms set forth in this contract. The Purchaser further understands and agrees that any breach of contract by the Purchaser may result in repossession of the abovementioned Labradoodle by Davis Doodles. Any legal expenses or other fees incurred by Davis Doodles to enforce this contract shall be the responsibility of the Purchaser. All terms, health warranties and guarantees shall be considered null and void should the Purchaser be in breach of any portion of this contract. No refunds will be issued by the Seller if the Purchaser voluntarily relinquishes ownership for any reason, or if any breach of contract by the Purchaser results in the repossession of the abovementioned Labradoodle.

This agreement must by signed PRIOR to this dog leaving our custody or the health warranty is null and void, and the Breeder is released from all contractual obligations.
